Parking Facilities: Are Your Parking Facilities A Lawsuit Waiting To Happen?

Parking lots and parking structures often provide criminals with the opportunity to carry out a wide range of criminal behavior such as auto theft and auto break-ins, robbery, assault and rape. They also provide an environment which often spawns litigation. Civil litigation can result from any and all of the afore mentioned criminal activity. Parking facilities can also produce litigation from accidents such as falls the result from aledged unsafe conditions.

For example, a few years back Bill Nesbitt was asked to testify in a case where a portable Stop Sign was blown over by the wind resulting in a severs laceration to a women's leg. She sued the hospital and the guard company because there was a post order stating that the sign should be laid on it's side on windy days.

Parking facilities that are not supervised can also produce altercations between visitors, especially when space is limited. We all know that everyone wants to walk the fewest steps possible, from theit cat to the hospital. Bill recently testified in a case involving two women who contested fro one parking spot. One of the women became so irate that she punched the other women in the face and beat her car with a tire iron. In order to successfully pursue a litigation the plaintiff must show that the incident or accident was foreseeable. In other words, the hospital should have known that there was a reasonable probability that the incident would occur.
